The Short-Term Work Allowance and Termination Ban Have Been Extended Once Again
The Short-Term Work Allowance is to be continued for an additional two months. Originally extended for one month from 30 June to 31 July 2020 and then for another month from 31 July 2020 to 31 August 2020 due to compelling reasons caused by Covid-19, the allowance has been extended for another two months to be valid from the end of the extension period with the Presidential Decree numbered 2915 published on 31 August 2020. Employers can apply for the allowance in cases where their employees’ weekly working hours are reduced by at least one-third temporarily due to "general financial, sector-based, regional crisis or compelling reasons”, or if their workplace halts operations completely or partially for at least four weeks, regardless of whether this stoppage is continuous or not.
On the other hand, with Presidential Decree numbered 2930 published on 04 September 2020, the termination ban and unilateral unpaid leave have been extended for two months to be valid from 17 September 2020. You can reach the decision here. (Available in Turkish only)
With the termination ban, no employment or service agreement may be terminated by the employer except:
- Situations that do not comply with the rules of ethics and goodwill
With the unilateral unpaid leave regulation, employers will be able to force employees to take unpaid leave wholly or partially, and taking unpaid leave within the scope of this regulation will not grant the employee the right to terminate the contract.
